Rights of Way

In our case, there was a shared right of way between the original owner and the subsequent owners – a local couple and a timbering company.

When we went to buy the land, our attorney discovered the previous sale overlooked one key component: the seller did not convey right of way to the correct portion of road way, thereby making the owner and seller legally landlocked from accessing their respective properties. Good catch!

One property we looked at while land shopping had a walking path right of way, right down the middle of the for sale property. This right of way was included so the seller could access a water well. No thanks!
